1. Identification of Parties. Agreement between [name] of [address] (Owner), and [name] of [address] (Broker). Broker is granted a nonexclusive agency to sell the Property identified in Paragraph 2. Broker is a real estate broker duly licensed under the laws of [state].
2. Description of Premises. Broker is granted a nonexclusive agency for sale of the following premises: [description of the premises], including the land and the buildings and other improvements located on it (Property).
3. Amount of Commission. Broker shall be entitled to a commission of ........ percent (........%) of the total sales price of the Property.
4. Entitlement to Commission. Broker shall be entitled to a brokerage commission if, as, and when title closes in the sale of the Property by Owner. Broker agrees that if Owner or any other broker procures a purchaser and the Property is sold to such purchaser, then Broker is not entitled to a brokerage commission or any other sum from Owner.
