Agreement To Secure Publication IllustratorTHIS AGREEMENT is made this _________ day of _________ 20 __, by and between ____________________ (hereinafter referred to as the "Author"), an individual with his or her principle place of esidence located at _________________, and _______________, (hereinafter referred to as the "Artist"), an individual with his or her principle place of residence at ______________________, do hereby agree to the following: WHEREAS, the Author has prepared a manuscript with a tentative title (title of book/publication) requiring illustrations. The manuscript for the publication consists of approximately (number) words. Pursuant to the specific terms and conditions herein the Artist shall prepare certain illustrative materials to be incorporated in the work. Two copies of the manuscript shall be sent to the Artist no later than (date). The materials contracted for herein shall be completed by the Artist no later than (date), provided that in the unlikely event that the manuscript is delayed in delivery, that the date for delivery shall be adjusted accordingly. COOPERATION & ASSISTANCE The Author shall provide reasonable cooperation and assistance to the Artist in preparation of all materials. The Artist shall prepare the following, to the satisfaction of the Author. TYPE OF FINISH The Artist shall provide to the Author a designed cover, with the original to be approximately (size in metric) in size in (mono/full/four colour) finished process. (Number) illustrations related to the agreed work, to be approximately (size in metric) in size, and in (mono/full/four colour) finish. MONETARY COMPENSATION The Artists shall be paid by the Author a total fee of (amount of dollars), to be paid as follows: (state amount and method of payment). No further compensation shall be due. The Author shall have the right to (limited/unlimited) reproduction of the illustrations thereafter. CONFIDENTIALITY The Artist shall keep the nature and existence of the work including all related information strictly confidential until the work is published and/or otherwise is released into the public domain sector. The Artist shall receive credit in all distributed versions and copies of the work as the Artist, in such places as are customary and usual within the publishing industry for the type of work performed. INDEMNITY The Artist warrants that the materials delivered herein are the original work of the Artist, and that the same do not violate any copyright, company/industry logo, trademark, and/or any other protection of intellectual property by the Artist. The Artist further warrants that the Artist has the full right to convey these rights granted to the Author herein. The Artist shall idemnify and hold harmless the Author from any such claims related to the work of the Artist. However, that in the event that the Author specifically requests in writing a particular form of rendering that the Author shall be fully responsible for such claims to the extent that they are caused by the Author's request. ENTIRE AGREEMENT This agreement, in its entirety, contains the full understanding of the parties. It may not be changed orally but only by an instrument in writing signed by the party against whom enforcement of any change, extension, modification, waiver or discharge is sought.
