Publication Agreement Freelance Writer

THIS AGREEMENT is made this _____ day of _____ 20 __, by and between ____________________ (hereinafter referred to as the "Publisher"), a company organized, and existing under the ws of the State of ______, with its principle place of business located at _________________, and __________________, (hereinafter referred to as the "Writer"), an individual with his or her principle place of residence at ________________, do hereby agree to the following:

WHEREAS, the Writer is commissioned to write an article of approximately ( ) words, with a working title of (name).

WORLD WIDE DISTRIBUTION

The article shall be subject to the editorial standards of the Publisher. The Publisher shall have the right to reject the final submission of the Writer. The Publisher shall be given all publication rights, on a world wide basis.

DATE OF COMMENCEMENT

The article shall be due no later than the _____ day of ______ 20 __, and THIS DATE IS FIRM. No compensation shall be paid to the Writer in the event that the article is delayed. In addition to the article, the Writer shall provide (exact number) of photographs suitable to the article.

INCURRED EXPENSES

Expenses of the Writer for the following categories of expenses shall be reimbursed, to a maximum of (amount of dollars). The Writer shall be paid (amount of dollars) for the article on publication.

COMPENSATION & DISTRIBUTION

The Publisher shall have the right, after acceptance, to "kill off" the article, and shall pay the Writer exactly one-half of the agreed compensation, and shall release first rights, world- wide, to the Writer. The Publisher shall retain the right to republish the article upon paying the difference between the kill fee and the agreed fee for the article.

ENTIRE AGREEMENT

This agreement, in its entirety, contains the full understanding of the parties. It may not be changed orally but only by an instrument in writing signed by the party against whom enforcement of any change, extension, modification, waiver or discharge is sought.
