AGREEMENT made by and between [Name] of [Address] hereinafter referred to as "Model", his or her heirs, executors, administrators, successors and assigns; and [Name] of [Address] hereinafter referred to as "Photographer"), his or her heirs, executors, administrators, successors and assigns;

Concerning photographs

WITNESSETH:

In consideration of the mutual covenants herein contained, the parties agree as follows:

1. Grant of rights

Model hereby gives Photographer, his or her associates, publishers, employers, and any other person or entity with whom he or she may contract for the use of the Photographs covered in this release, the absolute right and permission to copyright, publish and/or to use and reuse without restriction any photographs, portraits or pictures of Model, or in which Model may be included in whole or in part, which were taken on ________, 20 __, at ___________________. Photographer may use the photographs in any medium and for any purpose whatsoever, including but not limited to promotional and advertising uses and other trade purposes as well as using Model's name in conjunction therewith. Model also consents to the use of any printed matter in conjunction therewith.

2. Release

Model hereby releases and agrees to hold harmless all such persons and entities from any liability connected with an accidental or intentional distortion of said photographs that may occur in the taking of said pictures, in the subsequent processing thereof, or in the publication thereof.

3. Waiver of right to inspect

Model hereby waives any right he or she may have to inspect and/or approve the finished product which results from said photographs, or the use to which they are put.

4. Waiver of right of privacy

Model understands that by signing this form, he or she is waiving any right of privacy which might be infringed upon as a result of the publication of the said photographs.

5. Use of photographs

Model makes this authorization, release and agreement on the basis of the representation by the Photographer that the photographs are intended for the purpose of __________________.

6. Publication

Publication is at the sole discretion of Photographer. Photograph(s) may not be used at all.

7. Payment

Photographer shall pay Model at the hourly rate noted above.

8. Right to contract

Model is of full age and has every right to contract in his or her own name. Or, the Parent or Guardian signing below has every right to contract for Model. Model (and/or guardian) has read the above authorization, release and agreement prior to signing it and is fully familiar with its contents.

9. Interpretation.

This Agreement shall be governed by and interpreted in all respects in accordance with the Law of the United States, state [State].
