Agreement Waiving Support If Marriage Ends

1. Introduction. Agreement dated [date] between [name], residing at [address] (Prospective Wife), and [name], residing at [address] (Prospective Husband). The parties are to be married on [date], at [place of marriage].

2. Relinquishment of Support. The parties agree that if their marriage is terminated at any time by divorce, annulment, or dissolution, that neither Husband nor Wife will be liable for the maintenance of the other.

a. Public Maintenance. If either of the parties should at any time become unable to support himself (herself), this Agreement will be void and unenforceable.

b. Financial Statements. Both parties have attached financial statements [omitted] to this Agreement that demonstrate that each has adequate resources to support him or herself so that failure by the other to provide maintenance shall not be deemed unconscionable.

3. Children. If there are issues of the marriage, this Agreement between the parties shall not in any way affect the rights of the children to support from both their parents.
